1. Terms of Service

a. Our Mission

Founded in 2021, Beamya is a Zurich-based online experiences marketplace that helps companies build better relationships at work. We will re-imagine the way you work with your colleagues and make it funnier, simpler and better.

b. Searching and Booking on Beamya

Our marketplace brings together the best-in-class hosts across the world with employers from companies of all sizes, from global corporations to start-ups.

Searching

On the experiences page, you will find all the experiences that Beamya has available. You can apply filters to simplify your search. Experiences vary according to price, team size and the objective you want to achieve.

Booking

  • No strings attached: Book an experience one time or many times.
  • Cancel 48h before: No credit card details required. We accept many payment options.
  • Enjoy your time: We will send you straight an email with login details to connect.

Reservations for Experiences and Other Host Services

You are responsible for reporting any medical or physical conditions or other circumstances that may affect your ability to participate in, attend or use the Host Service. Unless expressly authorized, you may not allow any person to join a Host Service unless they are listed as an additional guest during the booking process.

c. Cancellations, Refunds and Booking Modifications

Experience Reservations are governed by the Guest Refund Policy.

d. Your Responsibilities and Assumption of Risk

Your Responsibilities

You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Experience. For example, this means: (i) You must act with integrity, treat others with respect, and comply with applicable laws at all times.

Your Assumption of Risk

You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the Beamya Platform and any Content, including your participation in any Experience or any other interaction you have with other Members online. This means it is your responsibility to investigate a Host Service to determine whether it is suitable for you. For example, Host Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Services.

2. Community Policy

2.1. Guest Release and Waiver

In order to participate in an Experience, you are required to agree to this Guest Release and Waiver, which is effective between you and your Host(s) as of the date when you first book or participate in an Experience, whichever happens first. All terms not defined here have the meaning given them in the Beamya Terms of Service and/or the Additional Terms for Experience Hosts.

If you are booking an Experience on behalf of other Guests, you will ensure, and you represent and warrant, that each Guest on whose behalf you book has read and agreed to this Guest Release and Waiver.

Assumption of Risks

You understand and acknowledge that the Experience(s) you sign up to do may be hazardous and may carry the risk of injury or illness, including sickness, physical injury, property damage, disability, permanent paralysis, and death.

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, YOU KNOWINGLY, VOLUNTARILY AND FREELY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, OF PARTICIPATING IN EACH EXPERIENCE, INCLUDING EACH EXPERIENCE IN YOUR IMMERSIVE EXPERIENCE, EVEN IF THOSE RISKS ARISE FROM THE NEGLIGENCE OR CARELESSNESS OF THE HOST OR OTHERS, OR DEFECTS IN THE EQUIPMENT, PREMISES, OR FACILITIES USED DURING THE EXPERIENCE, OR OTHERWISE, AND YOU ASSUME FULL RESPONSIBILITY FOR PARTICIPATION IN THE EXPERIENCE.

Release and Waiver

You acknowledge and agree that:

  • You have reasonably assessed the risks involved in the Experience(s) and have made an informed and voluntary choice to participate.
  • You alone, and not your Host(s), are responsible for determining your fitness for participating in the Experience(s) and your ability to fully understand any directions or warnings presented.
  • You will not participate in any Experience(s) when you have a physical, medical, or mental limitation or disability, or when you are aware or should reasonably be aware of any factors that may limit or prevent you from safely participating in that Experience(s).
  • You will act reasonably and responsibly and will comply with any provided and customary conditions, directions, and/or precautions for participation in the Experience(s). If you notice any hazard during an Experience, you will stop participating in the Experience immediately.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND PROMISE NOT TO SUE YOUR HOST(S) FOR ANY CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES (WHETHER ECONOMIC OR NON-ECONOMIC), DAMAGES, EXPENSES, COSTS OR LIABILITY OF ANY NATURE WHATSOEVER ARISING FROM OR IN CONNECTION WITH YOUR EXPERIENCE(S), WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY.

You intend this Guest Release and Waiver to be a complete and unconditional release of all liability to the greatest extent allowed by law. You agree that if any portion of this Waiver and Release is held to be invalid, the balance notwithstanding shall continue in full force and effect.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSTS PROVIDE THE EXPERIENCE(S) AND “AS IS,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOST(S) EXPRESSLY DISCLAIM ANY WARRANTIES OF SAFETY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND AS TO THE ADEQUACY OF THE DIRECTIONS AND WARNINGS PROVIDED TO YOU.

Indemnification

You agree that if, despite this Guest Release and Waiver, you or anyone on your behalf make a claim against the Host(s) relating to an Experience, you will indemnify and hold the Host(s) harmless from any liability, demand, loss, damage, or costs which the Host(s) may incur as the result of such claim.

You affirm that you HAVE READ THIS GUEST RELEASE AND WAIVER AND FULLY UNDERSTAND THE ASSUMPTION OF RISK, RELEASE, WAIVER, AND CONSENT CONTAINED IN IT. YOU FURTHER UNDERSTAND THAT YOU HAVE GIVEN UP RIGHTS BY AGREEING TO THESE TERMS, AND HAVE DONE SO FREELY AND VOLUNTARILY AND WITHOUT INDUCEMENT.

2.2. Guest Refund Policy

Refund Policy

The following situations are eligible for a Guest refund:

  • The Host fails to carry out the booked Experience or arrives more than 15 minutes past the stated start time, causing the Client to abandon the Experience.
  • The Host makes significant changes to the Experience after booking.
  • The Client cannot attend, or a Host cannot lead the Experience because of technical difficulties, including audio or visual issues.
  • The Host cancels the Experience. If this happens, the Client gets a full refund and can rebook the experience. This has however never happened before.

Cancel or reschedule an online Experience

  • The Client gets a full refund for any Experience if it is cancelled 10 working days before the Experience is scheduled to start.
  • The Client gets a full refund for any no-show if it is communicated to Beamya 10 working days before the scheduled Experience. Otherwise, the Client needs to pay the full amount for any reduction in the number of guests.
  • If the Client wants to reschedule the date and time of the Experience, he/she can do that up to 7 working days before the Experience starts.

General Provisions

This Experiences Guest Refund Policy does not:

  • constitute an offer to insure
  • constitute insurance or an insurance contract

Furthermore, the Guest has not paid any premium in respect of the Experiences Guest Refund Policy. The benefits provided under this Experiences Guest Refund Policy are not assignable or transferable by a Guest.

All determinations of Beamya with respect to the Experiences Guest Refund Policy shall be at Beamya´s discretion, and final and binding on the Guests and Hosts.

Beamya reserves the right to modify or terminate this Experiences Guest Refund Policy, at any time, in its sole discretion. If Beamya modifies this Experiences Guest Refund Policy, we will post the modification on the Beamya Platform or provide you with notice of the modification.

2.3. Community Standards

Creating a world where anyone can truly belong requires a foundation of trust grounded in consistent expectations of host and guest behaviour. We’ve established these Community Standards to help guide behaviour and codify the values that underpin our global community.

This is a living document, as we’re constantly refining our approach to meet the needs of our community. But these five standards—safety, security, fairness, authenticity, and reliability—remain central pillars in our efforts to help ensure safety and foster belonging. We’re always working to make sure they’re upheld and enforced.

Safety

Your Beamya experience begins the moment you embrace adventure. That’s only possible when you trust this community and feel safe. As a result, we require that you refrain from endangering or threatening anyone.

Harming yourself or others

You should not commit any act of violence. Members of dangerous organizations, including terrorists, organized criminals, and violent racist groups, are not welcome in this community. Beamya is committed to working with law enforcement as appropriate and responding to valid law enforcement requests.

We take suicide, self-injury, eating disorders, and hard drug abuse extremely seriously and work to help people in crisis.

Threatening anyone

You should not convey an intent to harm anyone by your words or physical actions. We also take threats of self-harm as seriously as we do actions and may intervene if we become aware of a threat.

Security

Our Beamya community members share their experiences. You should always  trust that you will feel secure. We ask that you respect the personal information of others.

 

Theft, vandalism, or extortion

You should not threaten anyone with bad ratings or any other penalty or harm to obtain compensation or other benefits.

Spam, phishing, or fraud

You should not make transactions outside of Beamya´’s payments system; commit booking fraud, credit card fraud, or launder money; attempt to drive traffic to other sites or market unrelated products; divert payments meant for others; abuse our referral system; or make false claims against other members of the community.

Violating others’ privacy or intellectual property rights

You should not spy on other people; cameras are not allowed in your listing unless they are previously disclosed and visible, and they are never permitted in private spaces (such as bathrooms or sleeping areas). You should not access others’ accounts without authorization or violate others’ privacy, copyrights, or trademarks.

Fairness

The global Beamya community is as diverse, unique, and vibrant as the world around us. Fairness is what holds us together, what makes it possible for us to trust one another, integrate seamlessly within communities, and feel as if we can truly belong.

Discriminatory behavior or hate speech

You should treat everyone with respect in every interaction. So, you should follow all applicable laws and not treat others differently because of their race, ethnicity, national origin, religious affiliation, sexual orientation, sex, gender, gender identity, disability, or serious diseases. Similarly, insulting others on these bases is not allowed.

Bullying or harassing others

You should not share personal information to shame or blackmail others, target others with unwanted behaviour, defame others, or violate our review and content standards.

Authenticity

Your Beamya experiences should be full of delightful moments and surprising adventures. Since our community is built on trust, authenticity is essential—it requires a balance of shared expectations, honest interactions, and accurate details.

Misrepresenting yourself

You should not provide a false name or date of birth, maintain duplicate accounts, or create an account if you’re under 18.

Reliability

Every Beamya experience is unique and each detail is specific to a host. Since our community makes commitments based on these details, we have to be able to trust each other’s reliability.

Breaking commitments

Absent extenuating circumstances, you should not cancel after the deadline set in the relevant cancellation policy.

Being unresponsive

You should not have persistently and pervasively low ratings, be unresponsive during booking or refuse to participate in our resolution process.

2.4. Kit Boxes

If the Client chooses to book an Experience with a kit box, the following terms apply:

  • The Client sends the shipping addresses of the kit boxes no later than 15 working days before the scheduled Experience to beamya.
  • beamya will not reimburse the Client for delayed deliveries if the addresses were sent less than 15 working days before the Experience.
  • The Client will be fully reimbursed in case of damages to the kit boxes caused by the shipment. The specific kind of reimbursement (new kit box, voucher, money refund) will be determined on a case-by-case basis with the Client.

3. How to attend an Online Experience.

The video communication platform that Beamya offers, as the first choice is Zoom. However, it can allow the use of another platform at the request of the customer but it must respect the same conditions as Zoom.

System requirements and internet connection

Before you attend your experience, make sure your device meets the Zoom system requirements and test your internet connection by joining a test meeting.

Maintaining your privacy when using Zoom

Your privacy is important to us. Here are the steps we’ve taken to help protect your privacy during online experiences, along with tips for you to protect your privacy when using Zoom. If any of the following settings aren't going to be applied to your experience, we'll notify you before you book.

How Beamya helps to protect your privacy when you use Zoom:

  • A random, password-protected meeting ID is created for each experience.
  • Guest video is turned off upon entry into the Zoom meeting room.
  • Guests cannot share their screens during the experience.
  • Files cannot be transferred through Zoom.
  • The "waiting room" feature is on by default, allowing hosts to admit guests into the Zoom meeting room individually.

Tips to help you protect your privacy:

  • Don’t share the password-protected Zoom meeting link with anyone else.
  • Use the most up-to-date version of the Zoom app.
  • Be aware of your surroundings and what’s behind you when you are on camera—your host and other guests will be able to see it.
  • Mute yourself until you’re ready to speak.
  • Take care when using the group chat feature as all participants will be able to read what you post.
  • If you don’t want to provide your full name to the guests and hosts of your experience, you can input a different handle or use your first name only when logging into Zoom.
  • Please do not screenshot or take photos of your host or other guests without their permission.

Where to meet your host

You’ll receive a link to join the experience online in your confirmation email, and in the reminder email sent before the online experience begins.

Log into Zoom at least 5 minutes early to make sure everything is working properly and that you are on time for the experience. It’s important to note that your host has the option to reject late guests, and that guests who arrive late are not eligible for a refund. Learn more in our Guest Refund Policy article.

Zoom issues

Make sure you have the correct link for your online experience. If the link isn't working, close Zoom and try again. If it is still not working, send a message to Beamya customer service to report the issue.

If Zoom is asking for a password, send a message to Beamya customer service to ask for the password.

Finally, if Beamya detects that the host has no problem, you will need to visit the  Zoom Help Center.

Privacy or safety issues during the experience

If you come across any inappropriate content, or have an issue concerning privacy or safety during your experience, contact Beamya´s community support and report it. Provide as much information as possible and Beamya will investigate the issue.
